Take Notice That the Council of the City of Kawartha Lakes passed Zoning By-law No. 2024-113 on the 21st day of May, 2024 under Section 34 of the Planning Act, R.S.O. 1990, as amended. In making its decision to pass the Zoning By-law, Council has considered all written and oral submissions made to Council before making its decision.

And Take Notice That pursuant to the provisions of Section 34(19) of the Planning Act, any individual, corporation or public body may appeal in respect of the by-laws to the Ontario Land Tribunal (the ‘Tribunal’) by filing a Notice of Appeal setting out written reasons in support of the appeal. Appellants must use ‘Appellant Form A1’ available from the Tribunal website at https://olt.gov.on.ca/. A notice of appeal must be accompanied by a fee of $1,100.00. The Tribunal may reduce fees for eligible private citizens and community groups. Fees for appeals that are $1,100 can be reduced to $400 when requested by those who are eligible at the time of the filing. The payment must be in the form of a certified cheque or money order, made payable to the Minister of Finance. Each appeal must be filed with the City Clerk at City Hall, 26 Francis Street, Lindsay, ON K9V 5R8, on or before June 11, 2024. Please refer to File No. D06-2022-06 (Rural Zoning By-law).

And Take Notice That only individuals, corporations and public bodies may appeal a Zoning By-law Amendment to the Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is the member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the Zoning By-law Amendment was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

Description of Subject Lands:

The Rural Zoning By-law applies to the areas of the municipality that are outside of the Urban Settlement Areas as shown in the Key Map.

The Purpose and Effect of By-Law Number 2024-113:

The purpose and effect of the proposed Repeal and Replacement of 14 of Zoning By-laws with the Rural Zoning By-law is to:

  • Consolidate and harmonize 14 Zoning By-laws into one Rural Zoning By-law.
  • Apply standardized development standards across the rural areas of the municipality.
